PARTIES & PROPERTIES: Lessor as defined above, hereby leases to Lessee, as defined above, on the terms and conditions hereinafter set forth, the Property, as defined above, for use as a private residence only.
TERM: This lease will commence and terminate on the dates defined above. If either Lessee or Lessor chooses to terminate this lease, at its expiration, they must give to the other a written notice 30 days prior to that date. This notice must be given on the 1st of any month only. Failure of either party to give notice as required, will automatically renew this lease and all of the terms thereof and the lease will be considered a month to month occupancy.
RENT: This lease is made for and in consideration of the monthly rental amount, as defined above, payable in advance on or before the 1st day of each month. Payments are to be made to:

or to any other location as may be requested by Lessor. Lessor acknowledges receipt from Lessee of the prorated rental amount as defined above which is prorated rent from the date of occupancy to the 1st of the following month.
LATE FEES: All rents are due on the first and considered delinquent by the 5th. ALL PAYMENTS RECEIVED AFTER THE 5TH MUST BE ACCOMPANIED BY AN ADDITIONAL $25.00 LATE FEE. Lessor at his option may choose not to accept payment if not made by the 5th or accompanied by the late fee, and Lessor may choose to execute eviction procedures.
NSF FEES: If Lessor is given a check and check is not honored upon presentation for any reason whatsoever, LESSEE AGREES TO PAY AN ADDITIONAL $25.00 FEE. IF FOR ANY REASON, LESSOR IS GIVEN TWO NSF CHECKS, LESSEE WILL BE REQUIRED TO PRESENT ALL FUTURE RENT PAYMENTS IN THE FORM OF CERTIFIED FUNDS ONLY.
SECURITY DEPOSIT: Upon execution of this lease, Lessee agrees to deposit with Lessor, the receipt of which is hereby acknowledged, a security deposit in the sum as defined on page one. This deposit which is non-interest bearing, is to be held by Lessor as security for the full and faithful performance of all of the terms and conditions of this lease. It is not to be considered as rent and may not be used by Lessee as such. Lessee shall be entitled to the return of this security deposit WITHIN 30 DAYS after the expiration of the lease and after move out of the Lessee and after the property has been inspected by Lessor, and provided:
1. ALL KEYS HAVE BEEN RETURNED
2. PROPERTY IS RETURNED TO LESSOR IN GOOD CONDITION. (NORMAL WEAR AND TEAR ACCEPTED).
3. ALL APPLIANCES, BATHROOM FIXTURES, CEILING FANS, CABINETS, FLOORS, CARPETS, LIGHT FIXTURES, WINDOWS, STORAGE AREAS, CLOSETS, WINDOW HANGING, BLINDS, WALLS AND OUTSIDE AREAS COMMON TO THE APARTMENT ARE CLEAN AND FREE OF DUST AND DEBRIS.
4. THERE IS NO DAMAGE TO THE APARTMENT, OR ANY OF ITS EQUIPMENT OR FIXTURES.
5. ALL RENTS HAVE BEEN PAID, INCLUDING LATE CHARGES AND NSF FEES.
6. THERE IS NO DAMAGE CAUSED BY PETS REGARDLESS OF THE PET FEE PAID.
7. ALL BURNED OUT LIGHT BULBS ARE REPLACED.
8. YOU HAVE GIVEN A PROPER 30 DAY WRITTEN NOTICE (ON THE 1ST OF THE MONTH).
9. YOU HAVE GIVEN LESSOR A FORWARDING ADDRESS.
10. ALL TERMS AND CONDITIONS OF THE LEASE HAVE BEEN MET.
Lessee understands that the amount of the cost to remedy the above will be deducted from his deposit and agrees to pay upon demand for any costs that may exceed the amount of the deposit. Lessee fully understands that the full security deposit will be forfeited if the property is abandoned, or vacated prior to expiration of this lease.
OCCUPANTS: Only the Lessee and occupants as defined on page one are allowed to occupy the property. Visitors (defined as someone who is in the residence for no more than 10 days at any time during the term of this lease) are allowed.
PETS: Pets of any kind are not allowed unless approved by Lessor and a PET LEASE is executed, and made a part of this
